The profundity of this sentence touches the roots of the philosophy of law, as well as the understanding of law. Justice and the rule of law presuppose each other. Nevertheless, contradictions between the rule of law and justice in the individual case are not excluded. When such contradictions occur, a "cold shock" induced by the rule of law can be the result. Example cases are the criminal prosecution of former office-holders in the GDR, as well as the restitution principle instead of compensation for confiscated property also in the GDR. The decision to employ the restitution principle was a mistake politically, legally not mandatory and has justifiably left many people in the new Federal states in doubt about the principle of justice.
